Despite clearing out her mothers savings, a drug user, mother-of-five McVicar, has been given a second chance by a Judge in the hope that she could turn her life around.

Jennifer McVicar, of no fixed abode, helped herself to cash savings from her mothers bank account to the sum of just under £5,000 between May & June 2018.

Snaresbrook Crown Court last week heard that the money was transferred during 30 separate transactions from her mothers bank account to McVicars drug dealers.

Owing to her poor eyesight, McVicar’s mother allowed her daughter to have access to her online banking so that she could help her to carry out her day-to-day banking activities; something McVicars mother cannot do without assistance.

However, McVicars mother noticed that the funds were going missing after she attempted to withdraw some money out of her account using an ATM only to be notified that she had no money left in her account.

McVicar owned up to her mother shortly after and was arrested by Officers from the Met Police in connection with the theft

Prosecuting on behalf of the CPS, Jonathan Whitley told the court that McVicar had initially stated that she was being ‘forced’ to send the stolen money to her drug dealers – but did not keep to these claims.

Defending McVicar in Court, Nasreen Tinsey, said that McVicar was in a ‘downward spiral’ after her FIVE children had been taken into care by social services.

Tinsey explained to the Court that ‘it would be more constructive for any sentence to be suspended so she can get the support she needs back in society’.

Presiding Judge Mr Nicholas Huskinson agreed with this sentiment and suspended McVicars’ sentence that was handed down.

‘You have pleaded guilty to a serious offence,’ he said.

Judge Huskinson continued: ’You defrauded your mother who is someone who has her own health problems and was looking to you to help her.

‘You were apparently given her bank details and that let you make 30 separate transfers to persons who were supplying you drugs.

‘This was a serious abuse of trust and this £5000 was a substantial loss to her, making matters worse.

‘But you are of previous good character and need help tackling your drug problem so I will suspend the sentence.

‘You must take this opportunity to turn your life around.’

McVicars was sentenced to 10 months suspended for 18 months and was also ordered by the court to undertake a 6 month drug rehab programme.

Drug rehabilitation itself is the processes of medical or psychotherapeutic treatment for dependency on psychoactive substances such as alcohol, prescription drugs, and street drugs such as cocaine, heroin or amphetamines.

The general intent behind these programmes is to enable the patient to confront substance dependence, if present, and cease substance abuse to avoid the psychological, legal, financial, social, and physical consequences that can be caused, especially by extreme abuse.

Treatment includes medication for depression or other disorders, counselling by experts and sharing of experience with other addicts.

According to the Metropolitan Police, there were 32,630 crimes recorded for drug possession in 2017-18 compared to 34,855 for the previous year (16-17).

For the same period (17-18) there were 2835 offences regarding drug trafficking compared to 3864 for the period 16-17.
